Hemp growers and processors across the state have been impatiently awaiting news about New York’s plans to regulate the now unregulated CBD industry. As more people realize the health benefits of CBD, so do those who wish to profit from the allure of fast money to be made on a quickly expanding and shifting market with no Federal oversight. Many New York farmers went belly up banking on hemp. Inexperience and unscrupulous processors typically led to their demise. Now New York is taking the bull by the horns.
On October 28th, 2020 Governor Cuomo announced proposed regulations for CBD products in conjunction with his Cannabinoid Hemp Program, which seeks to regulate processors and retailers through a licensing framework consisting of extensive fees and strict laws promulgating everything from manufacturing procedures to end-product labeling and testing requirements. The hope, says Cuomo, is to protect both consumers and farmers in an industry already besieged by tainted or bogus products.
The regulatory process requires a 60 day comment period, and the Department of Health is now developing applications to be accepted from processors, manufacturers and retailers in early 2021. Once the law is finalized, anyone found processing or selling CBD products without the appropriate licensure will face hefty penalties, effectively displacing those who are unable to pay the extensive licensing fees or provide a quality product.
